A district judge has tossed out parts of Big City Coffee’s $10 million lawsuit against Boise State University.

But pieces of the lawsuit will proceed, Margaret Carmel of BoiseDev.com reported Tuesday.

District Judge Cynthia Yee-Wallace dismissed the university and President Marlene Tromp from the lawsuit, Carmel reported. However, Big City can continue to pursue its case against Tromp chief of staff Alicia Estey; Francisco Salinas, Boise State’s assistant to the vice president for equity initiatives; and Leslie Webb, Boise State’s former vice president for student affairs and enrollment management.

The lawsuit stems from a short-lived Big City shop on the Boise State campus.

Big City opened a shop at Boise State in 2020, but closed its doors two months later, amidst backlash over Big City owner Sarah Jo Fendley’s vocal support of law enforcement. (Fendley’s fiancé, Kevin Holtry, is a former Boise police officer who was paralyzed when he was shot while on duty in 2016.)

Fendley has argued that she was forced off campus, a claim university officials have denied.

Fendley’s attorney, Michael Roe, must now file an amended complaint by May 27, Carmel reported, and Boise State would have to respond to a new complaint by June 24.
